1. Promoter

The promoter is NEXTGEN EVOLUTION PTY LTD trading as Australian Evolution (ABN 24 690 877 779), of Australian Evolution, Level 3, 39 Chamberlain St Campbelltown 2560, NSW (“Promoter”). Contact: hello@australianevolution.com.au

2. Promotional period

The promotion opens at 12:00 am AEDT on 1 November 2026 and closes at 11:59 pm AEDT on 30 November 2026 (“Promotional Period”). All times in these Terms & Conditions are Australian Eastern Daylight Time (Sydney time).

Orders must be placed and successfully paid during the Promotional Period. Orders placed outside this period are ineligible. The Promoter’s order system records will be used to establish the order time, subject to correction of any verified error.

3. Eligibility

Entry is open to Australian residents aged 18 years or older at the time of entry, residing in any Australian state or territory.

The Promoter’s directors, management and employees, persons and agencies involved in conducting or promoting this giveaway, and their immediate families are ineligible. Immediate family means a spouse or partner, parent, child or sibling.

An entry belongs to the individual customer who places the qualifying order. The Promoter may request reasonable evidence of identity, age, residency and order ownership to verify eligibility.

4. How to enter

To enter, place and successfully pay for an order through australianevolution.com.au during the Promotional Period containing $100 or more in eligible products, after discounts and excluding shipping.

Each qualifying order automatically receives one entry. No separate entry form, social media action or marketing email subscription is required. There is no additional entry fee. Goods are sold at their normal advertised prices, without an increase attributable to the giveaway.

Eligible merchandise value is the amount paid for products, including GST where applicable, after discount codes and other discounts. Shipping charges, payment surcharges and purchases of gift cards do not count towards the $100 threshold. Payment for eligible products using an existing gift card counts towards the threshold. An order paid through an accepted buy-now-pay-later provider qualifies when the payment is successfully authorised and accepted by the Promoter; customers do not need to complete all installments during the Promotional Period.

Multiple entries are permitted through separate qualifying orders. There is no maximum number of qualifying orders per eligible customer.

• One order of $100 or more receives one entry.

• Three separate qualifying orders receive three entries.

• One order of $300 receives one entry.

• An order of $99.99 receives no entry.

Separate orders cannot be combined to reach $100. Splitting an order into multiple shipments does not create additional entries. Administrative replacement orders, exchange-only orders and orders created without a new qualifying purchase do not create additional entries.

Customers may opt out of the draw by emailing hello@australianevolution.com.au with their order number before the draw.

5. Cancellations, returns and refunds

Eligibility will be checked immediately before the draw. An order is ineligible if it has been cancelled or fully refunded, or if cancellations, returns or partial refunds reduce its retained eligible merchandise value below $100 before the draw. Returns already accepted or approved for refund before the draw will be taken into account even if the refund has not yet been processed.

Where a partial cancellation, return or refund leaves an eligible merchandise value of at least $100, the order retains its one entry.

Participation does not restrict any customer’s rights under Australian Consumer Law or the Promoter’s applicable returns policy. A lawful return after the draw does not, by itself, require the winner to surrender the prize. Fraudulent transactions or entries may be excluded under clause 11.

6. Prize

There is one prize bundle for one winner, comprising all five products below:

 

All five prize products are Australian made. The winner may select from the available applicable sizes and colours of the listed products at the time of prize selection. Standard pillows and king size pillows are supplied in their respective listed sizes.

The maximum prize value is based on the highest-valued available variant of each product. The actual bundle value varies according to the winner’s selections and may be less than $500. Values are the genuine RRPs of the relevant products as at 1 November 2026. Current promotional selling prices may differ.

The prize includes free delivery to the winner’s Australian address. No payment or additional purchase is required to claim it. The prize cannot be exchanged for cash or credit or transferred at the winner’s request, except where required by law.

If a listed prize is unavailable, the Promoter will seek the winner’s written agreement to a similar Australian-made substitute of equal or greater value, subject to applicable law and any required regulatory approval. The Promoter will not reduce the advertised prize entitlement unilaterally.

7. Draw

The draw will take place on 2 December 2026 at 7pm AEDT, at Australian Evolution Head Office, Level 3, 39 Chamberlain St Campbelltown 2560, NSW.

The Promoter will compile and validate a final list containing each qualifying order number once. A computer-based random number generator will select one order number from the complete eligible list. Every valid entry has an equal chance of selection. A customer with several qualifying orders has one chance for each such order.

The number of eligible entries determines the odds of winning. Entrants do not need to attend the draw. The draw will be screen-recorded and the final entry list and result retained for audit purposes. Where practicable, members of the public will be given an opportunity to witness the draw. If the selected entry is verified as ineligible, a further random selection will be made from the remaining eligible entries using the same method, with the reason recorded.

8. Winner notification and publication

The winner will be notified in writing at the email address associated with the qualifying order immediately following the draw. The notification will identify the prize and explain how to claim it. The Promoter will make reasonable further attempts to contact the winner, including using an available order contact number if appropriate.

The winning entry number and prize description will be published by 2 December 2026 at https://australianevolution.com.au/pages/competition-winners, and remain available for at least 28 days. The winner’s first name, surname initial and state or territory may also be published following verification. Any further publication required by law will be limited to the required details.

The complete entrant list and any recording displaying other customers’ personal information will not be published publicly. Marketing subscription or continued subscription is not required to receive a winner notification or claim the prize.

9. Claim deadline and unclaimed prize draw

The winner must respond to the notification and provide the information reasonably required to verify eligibility and arrange delivery by 11:59 pm AEDT on 17 December 2026.

If, despite reasonable contact attempts, the prize remains unclaimed by that deadline, an unclaimed prize draw will take place on: 7:00 pm AEDT, 18 December 2026 at the same address as the original draw, subject to any required regulatory directions or approvals.

The redraw will use the same random selection method from the remaining valid original entries, excluding all entries belonging to the winner who forfeited the prize. No new entries will be accepted. The redraw winner will be notified in writing immediately following the draw, and the result will be published on the Winners page immediately following the draw and remain published for at least 28 days.

The redraw winner will be given at least 14 days from written notification to claim the prize. If it remains unclaimed, the Promoter will follow applicable regulatory requirements and directions before conducting any further draw. The prize will not jackpot into another promotion.

10. Prize delivery

The Promoter will arrange free delivery and transfer the prize to the verified winner within 28 days of the relevant draw, subject to applicable law. The winner must supply an accurate Australian delivery address and make size and colour selections promptly. Any proposed delivery delay will be discussed with the winner and agreed in writing where legally permitted. The bundle may arrive in more than one shipment.

The winner will not be required to purchase anything, provide a testimonial or agree to additional promotional publicity to receive the prize.

11. Fair administration

The Promoter may exclude entries supported by reasonable evidence of fraud, unauthorised payment, deliberate manipulation of the draw or failure to meet these Terms & Conditions. Valid repeat purchases are permitted and will not be excluded merely because a customer places multiple orders.

The Promoter will administer the promotion fairly and in accordance with applicable law. Any amendment, suspension or cancellation will occur only where lawful, with any required prior regulatory approval and reasonable notice to affected entrants. This clause does not permit the Promoter to disregard valid entries or withhold an awarded prize arbitrarily.

Nothing in these Terms & Conditions excludes or limits any right, remedy, guarantee or liability that cannot lawfully be excluded, including under Australian Consumer Law.

12. Privacy and records

The Promoter will use order information, including customer name, contact details, order number and order value, to administer the promotion, verify entries, conduct the draw, contact the winner, publish the result as described above and deliver the prize.

Information may be provided to service providers assisting with these functions and to regulators where required by law. Draw services will be supplied only with the information needed to perform their function. Promotion records will be securely retained for five years after finalisation to meet applicable record-keeping requirements, and subsequently handled in accordance with legal obligations and the Promoter’s Privacy Policy.

Entry does not itself constitute consent to receive marketing messages. Promotional emails will be sent only where separately permitted by law, and unsubscribing does not invalidate an otherwise eligible entry. 13. Social media

This promotion is not sponsored, endorsed, administered by or associated with Facebook or Instagram. Entrants provide their information to the Promoter. To the extent permitted by law, entrants release Facebook and Instagram from claims arising from this promotion. No social media account, sharing, tagging or following is required to enter.
